U Visas for Crime Victims

The U visa is available to immigrants who have been the victims of certain types of serious crimes. The U visa permits the victim to legally live and work in the U.S. and to apply for permanent residence (i.e., a “green card”). The U visa is also available to the victim’s immediate family members.

Many immigrants are the victims of serious crimes but do not report the crime due to cultural differences. The U visa was created as an effort to encourage such victims to come forth, report the crime, and cooperate with law enforcement to apprehend and convict the criminal offender.

Visa for Crime Victims

In order to qualify for the U visa, the following is generally required:

  • The immigrant must have been the victim of a “qualifying criminal activity” in the U.S. Indirect victims can also qualify under certain circumstances. The types of crimes that qualify include domestic violence, kidnapping, rape, blackmail, manslaughter, and other such serious crimes. The attempt or conspiracy to commit any of the qualifying crimes also qualifies.
  • As a result of the criminal activity, the victim must have suffered “substantial” physical or mental harm. Proof of the harm suffered must be provided with the U visa application.
  • The victim must have cooperated or will cooperate with law enforcement by providing information that could lead to the identification, arrest, and conviction of the criminal offender. However, the actual arrest or conviction of the criminal offender is not required. The victim need only show that he or she cooperated with law enforcement. A certificate signed by a government official is required. This certification serves as proof that the immigrant was the victim of a qualifying crime, has useful information, and has cooperated with law enforcement.
